Terms of Service
Effective date: May 17, 2026
These Terms of Service (“Terms”) govern your use of the What A Team mobile application (the “App”) provided by Emilio Rios (“we”, “us”, “our”). By creating an account, joining a team, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms work together with our Privacy Policy, Child Safety Standards, and Impressum, which together form your agreement with us.
1. About the App
What A Team is a free peer-recognition app for small teams. Members co-create a short list of shared values and recognize each other through brief notes called “High Fives”. The App is provided at no charge. There are no in-app purchases, subscriptions, or advertising.
2. Who Can Use the App
You may use the App if you are at least 13 years old, or the higher minimum age that applies in your country. The App is not directed at children under 13 — see our Child Safety Standards.
If you create or join a team on behalf of an organization, you confirm that you have the authority to do so.
3. Your Account
To use the App you sign in with your Apple ID or your Google account. The display name you choose is what your teammates see in the App.
You are responsible for activity that occurs under your account. If you believe your Apple ID or Google account has been compromised, secure it with the respective provider — we do not manage those credentials.
You can delete your account at any time from the Profile screen, or by following the instructions on the Delete Your Account page.
4. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial use, subject to these Terms and the rules of the app store you downloaded it from.
You may not:
- Copy, modify, reverse-engineer, decompile, or create derivative works of the App, except where permitted by mandatory law.
- Resell, sublicense, or rent the App or any account.
- Circumvent or attempt to circumvent any security, rate-limit, or access-control feature.
- Use the App to build or train a competing product, or to perform automated scraping or harvesting.
5. Acceptable Use
When you use the App you agree not to:
- Send messages that are harassing, threatening, defamatory, hateful, discriminatory, sexually explicit, or otherwise inappropriate.
- Impersonate another person or misrepresent your identity or affiliation.
- Upload, share, or transmit content that is illegal, infringes someone else’s rights, or violates anyone’s privacy.
- Use the App to send spam, advertising, chain messages, or unwanted bulk communications.
- Interfere with the App’s operation, exploit bugs to gain unauthorized access, or attempt to access data you are not authorized to see.
- Use the App in any way that violates applicable law.
Violations may result in removal of content, suspension, or termination of your account.
6. Your Content
You retain ownership of the content you create in the App — your display name, the names and emoji of teams you create, the values you choose, and the High Fives you send. We refer to all of this as “Your Content”.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display Your Content only as necessary to operate the App — for example, to deliver a High Five to its recipient, to show it in the activity feed of your team, or to send a related push notification. This license ends when you delete the content or your account, except (a) for copies we are legally required to retain, and (b) for content that other team members have already received, which may remain in their view of the team’s history.
You represent and warrant that Your Content does not infringe any third party’s rights and complies with these Terms and applicable law.
7. Other People’s Content
The App lets you see content from your teammates. We do not pre-screen what teammates send. You agree that any reliance on content from other users is at your own risk and that we are not responsible for content created by other users.
If you believe a teammate’s content violates these Terms or the law, see Section 8.
8. Reporting and Moderation
We may remove content, restrict features, or suspend or terminate accounts that we reasonably believe violate these Terms or applicable law. We will act in good faith and, where reasonable, give notice.
To report a violation, email us at the address on the Impressum page.
9. Third-Party Services
The App relies on third-party services that have their own terms and privacy policies:
- Firebase / Google Cloud Platform — backend infrastructure.
- Sign in with Apple and Google Sign-In — sign-in providers.
- Apple App Store and Google Play — distribution of the App.
By using the App you also accept the terms of these providers as applicable. We have no control over and are not responsible for their services, but we choose them in good faith.
For iOS users: these Terms are an agreement between you and us, not with Apple. Apple is not responsible for the App or any claims relating to it. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you as an end user.
10. Changes to the App
The App is provided as it currently exists, and we may add, change, or remove features at any time. We try to avoid breaking changes, but we cannot guarantee that any specific feature will remain available.
11. No Warranties
The App is provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses, or that any data you send through the App will be delivered, retained, or kept private indefinitely. You are responsible for backing up anything important to you outside the App.
Nothing in this section limits any statutory rights you have as a consumer that cannot be waived by agreement.
12. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any damages arising from your use of, or inability to use, the App — including indirect, incidental, consequential, or punitive damages, or for lost profits, lost data, or lost opportunity. These exclusions apply to claims in contract, tort, statute, or otherwise.
This exclusion does not apply, as required by mandatory German law, to:
- damages caused by our intent or gross negligence;
- damages resulting from injury to life, body, or health;
- liability under the German Product Liability Act; and
- breaches of essential contractual obligations (Kardinalpflichten), in which case our liability is limited to damages that were foreseeable at the time of contracting and typical for an app of this kind.
13. Suspension and Termination
You can stop using the App at any time and delete your account from the Profile screen.
We may suspend or terminate your account or access to the App if you materially or repeatedly violate these Terms, if we are required to do so by law, or if continuing your access would create a meaningful risk for us or other users. Where reasonable, we will give you notice and an opportunity to correct the issue first.
Provisions that by their nature should survive termination (including Section 6 last sentence, Sections 11, 12, and 15) continue to apply after termination.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the new version on this page with an updated effective date. For material changes, we will give notice through the App or by email where reasonably possible. Your continued use of the App after the new Terms become effective constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.
If you are a consumer resident in the European Union, the mandatory consumer protection laws of your country of residence apply alongside this agreement, and nothing in these Terms removes rights you have under those laws.
Consumer dispute resolution. Pursuant to § 36 of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG), we inform you that we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
16. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, Child Safety Standards, and Impressum, are the entire agreement between you and us regarding the App.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer ours to a successor in connection with a business reorganization or transfer of the App.
- Language. These Terms are provided in English. If they are translated, the English version controls in case of conflict, except where mandatory consumer law provides otherwise.
